LAST WILL AND TESTAMENT OF PHILIP MELVIN DEC’D
I Philip Melvin of the City of Pittsburgh County of Allegheny and commonwealth of Pennsylvania do hereby make my last Will and testament this thirteenth day of April Anno Domini one thousand and eight hundred and thirty four.
Item 1. I give and bequeath to my brother James Melvin and Isabel his wife (or the survivor) during the natural life, the net proceeds of the ground rent of Maddock alley in the city of Pittsburg, after paying to the heirs of Dr. George Stevenson one hundred and twenty dollars per annum, in quarterly payments, and after the decease of my brother James and Isabel his wife, I bequeath twenty five dollars annually of the aforesaid ground to their daughter Jane Boyle or to her heirds or assigns forever. And the balance of the ground red aforesaid I give to my neice Mary Mitchell wife of James E. Mitchell, to her heirs or assigns forever, in consideration of the aforesaid grant to Mary Mitchell, her husband James E. Mitchell, during this natural life or the heirs or assigns of Mary Mitchell, shall collect all the aforesaid ground rents of Maddock alley and pay one hundred and twenty dollars per annum in quarterly payments as aforesaid to the heirs of Dr. George Stevenson and also twenty five dollars per annum as aforesaid to Jane Boyle and should the said James E. Mitchell refuse or neglect to collect the aforesaid ground rents and (illegible) directed then the said Jane Boyle shall be at liberty to have the whole of the aforesaid ground rent collected and after paying the expenses of collecting and paying one hundred and twenty dollars annually to the heirs of Dr. George Stevenson ensure and retaining twenty five dollars per annum for her own use shall pay over any balance that may pertain to her sister Mary Mitchell.
Item 2. I bequeath to James Melvin Jn. Son of James Melvin Sen. One hundred dollars.
Items 3. I bequeath to Jane Melvin daughter of James Melvin Jr. one hundred dollars.
Item 4th. I bequeath to my sister Mary all dividends arising and payable on ten shares of stock in the Monongahela Bridge Company during her natural life, and after her decease I give to Philip Melvin son of James Melvin the aforesaid ten shares in the Monongahela Bridge Co. or to his heirs or assigns forever.
Item 6th I give and bequeath to my brother’s sons grand children the children of Elizabeth Irwin as follows viz.

Item 6th. I bequeath to my brother Samuel’s four children now in America as follows.

To Philip Melvin, son of my brother Samuel, ten shares of the capital stock of the Bank of Pittsburg forever and my silver spoons.
I give Philip Melvin Jr. ten shares of the capital stock of the Bank of Pittsburg in trust for William and Jane Justice during their natural life, the dividends of which to be paid to them as (can’t read it) and should Jane Justice aforesaid die the stock at their decease must be sold and the proceeds divided among her brother s John, William and Philip or their children.
Item 7th I give my brother William Melvin’s children as follows.
To his son John four hundred dollars. To his daughter Mary Williams one hundred dollars. To his daughter Elizabeth Stale three hundred dollars.
To his daughter Jane Austin four hundred dollars.
.....To his son Samuel (something) America ten shares of the capital stock of the Bank of Pittsburg forever. Also my eight day clock.
Item 8th. I give Sarah Morrison daughter of my sister Sarah three hundred dollars.
Item 9. I give to my brother Samuel’s children as follows.
To his son Richard four hundred dollars.
To his son James four hundred dollars.
To his daughter Mary three hundred dollars.
Item 10. I give to John Snyder my books, barouche, whips, and harness for two horses.
Item 11. I give to Jane McGowan wife of William McGowan one hundred dollars.
My farm is to be sold by my executor at whatever period he may think proper to make the sale.
The residue of my property should any remain, is to be equally divided amongst the aforementioned legatees.
I appoint my friend John Snyder sole executor of this my last will and testament.
In testimony whereof I have hereunto set my hand and seal this thirteenth day of April 1834.

LAST WILL AND TESTAMENT OF JANE JUSTIS
I Jane Justis widow of the City of Allegheny and State of Pennsylvania do hereby make and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made. I direct that all just debts and funeral expenses be paid as soon after my decease as possible as to such estate as it hath pleased God to intrust me with, I dispose the same as follows. Viz:
Item: I leave three hundred dollars to be extended in erecting tomb stones over my own my husband's and uncle Philip Melvins graves in Hilldale Cemetery.
Item: I give and bequeath to Catharine Love grand daughter of my brother John Melvins the sum of one hundred dollars.
I give and bequeath to my niece Ann Jane Breckenridge the sum of twenty five dollars and my dresses and wearing apparel.
I give to my niece Elizabeth Davis my dressing bureau, one bed and bedding and one carpet in my bedroom.
Item: I will and bequeath to Jane M. Boyle daughter of my friend N. M. Boyle Four shares of the Bank of Pittsburgh.
Item: I will and bequeath to Thomas J. Boyle son of my friend N. M. Boyle five shares of the Allegheny Dispensing Bridge.
Item: I give and bequeath to Isaac Brown the sum of fifty dollars.
I give and bequeath to Catharine McFarland all my Queensware.
I give and bequeath to Eliza McFarland the sum of fifty dollars.
I give and bequeath to Mrs. McKeown wife of Thomas McKeown the sum of twenty five dollars.
Item: I give and bequeath to my brothers John and Philip Melvins children that may be living at my death the balance of all my moneys stocks and household goods not enumerated here or mentioned or devised before all to be converted into money and to be equally divided among them share and share alike and I hereby appoint my friend N. M. Boyle executor of this my last will and testament: whereof I Jane Justis the testatrix have to this my will set my hand and seal this 24th day of December 1874. I doubt that the poor man died in 1866 and wasn't buried until 1875. 1866 must be when the will was written?

Notes for JOHN MELVIN:
John emigrated to America about 1828, based on his obituary. He left Pennsylvania for Kentucky about 1839. He married Jennie Sloane.

Parish records have a John Melvin baptized March 10, 1795 in Cumrin, Clough, County Down, Ireland, son of Wm. Melville. I haven't found a John Melvin born to Samuel Melvin yet.

In the name of God.I John Melvin being far advanced in years knowing the uncertainty of life, and the certainty of death, and being in sound and disposing mind and accuracy do make and declare this my last will and testament.
Item 1st I have no property now under my control to dispose of, but as I understand property to have been left me by my deceased Brother William Melvin to be subject to my possession at the death of his and my sister Jane Justice of Allegany City in the State of Pennsylvania, and I expect my Sister to bequeath me something--amount of either I do not know--and it is my wish that all that shall be coming to me from my said Brother and Sister shall go to my beloved daughter Ann Lovet, and I hereby give and bequeathe the same to her in view of her extraordinary kindness, care and attention that she has manifested in taking care of me in sickness infirmity and advanced age, and the confidence I have that she will continue to same while I live and at my burial.

To my other children James Melvin, William Melvin and Mary Ransom, I give bequeath my kindest regard and affection ten dollars each of the property coming from said Brother and Sister.

Riley Clerk of the Circuit Court of Jennings County, in the State of Indiana, and being duly sworn by the Clerk of said County, upon his oath declared and testified as follows, that is to say: that on the tenth day of June 1872 he saw the said John Melvin sign his name to said instrument in writing as and for his last will and testament and that this deponent at the same time heard the said John Melvin declare the said instrument in writing to be his last will and testament and that the said instrument in writing was at the same time at the request of the said John Melvin and with his present attested and subscribed by the said affiant and Simon Gasper in the presence of the said testator and in the presence of each other, as subscribing witnesses thereto, and that the said John Melvin was at the time of the signing and Subscribing of the said instrument in writing as aforesaid, of full age (that is more than twenty-one years of age) and of Sound and disposing mind and memory, and not under any coercion or restraint as the said deponent verily believes, and further deponent says not.

DEATH OF A CENTARIAN
Mr. Barney Barnum informs us of the death of John Melvin which took place at the residence of Christopher Lovett, his son-in-law, on Friday 6th ins., at the advanced age of 106 years. Deceased was a native of Ireland but had resided in this country 46 years. He had been blind the past eight years. A sister two years older than the deceased is said to be still living in Pennsylvania.

John and Jennie(Jane) MELVIN arrived in Pennsylvania from County Down Ireland in 1839 with 6 of 7 children, leaving a son of 4 years behind considering him too young to survive the voyage. They were in Jefferson Co. IN by 1850 and in Oldham and Trimble Co. KY in the 1860 federal census. Does anyone have any information about the circumstances of their deaths or their place of burial? I am a direct descendant through their son William who married Elizabeth Jane PALMER. The 12th of 13 children son Daniel married Edna Garrett in 1906. Their daughter Margaret was my mother. She married Earl Mahoney July 19, 1945. Thank you.

Brown, HISTORY OF BUTLER CO. PENNSYLVANIA, 1895, p. 1277:
PHILIP MELVIN, a native of Down county, Ireland, son of James Melvin, was born in 1802, grew to maturity in his native land, and about 1821 immigrated to Allegheny county, Pennsylvania. He learned the cooper's trade in that county, and followed it for some years in Allegheny City. He married Eliza Seth, a daughter of Jacob Seth, of Beaver county, to which union were born the following children: Ann J., wife of James M. Breckenridge; Elizabeth, wife of Frank Davis; David R.; Charlotte, deceased wife of William Lock, and Philip S., of Kansas. In 1886 Mr. Melvin removed to Muddy Creek township, Butler county, and settled upon the farm now in possession of his son David's children. He purchased 200 acres of land, which was patented by James Stewart in 1787. Here he erected a home and devoted the remainder of his life to agricultural pursuits, in connection with his trade, which he followed down to within a few years of his death, in 1882. In early manhood he was a Whig, and afterwards a Republican, and always took a deep interest in political matters. Mr. Melvin was one of the original members of the Methodist Episcopal church of Portersville, and died a member of the society at Prospect.

DAVID R. MELVIN was born in Allegheny, Pennsylvania, November 14, 1832, and is the eldest son of Philip and Eliza Melvin. He remained with his parents until he learned the wagon-maker's trade, and in 1856 established that business upon his farm in Muddy Creek township, and conducted the same for twenty years. He also engaged in farming. In 1855 he married Susan Roberts, a daughter of William Roberts, of Lawrence county, to which union have been born eight children, six of whom survive, as follows: Emma, wife of Gilmer Sharp; Herman P.; Olive, wife of A. J. Francis; Jennie, wife of Wm. S. Lutz; William W.; and Augustus H. Mr. Melvin is a Republican, and has filled the offices of constable, supervisor and school director. He is a member of the Methodist Episcopal church of Prospect.

Notes for CHRISTOPHER LOVETT:
May (Parker) Zimmerer suggests he came from County Cork. He was Catholic. Family legend says his father was the caretaker on the estate of wealthy Presbyterians named Melvin, and Christopher fell in love with Ann, daughter of Agusta Melvin. Marriage being forbidden, they eloped to Enland, where he worked in the shipyards. Later they came to America, with one daughter--Mary, called "Mollie"--being born at sea on 23 March 1845.

There are several big problems with this pretty tale. One is that EARLY LANDOWNERS OF JENNINGS COUNTY, page 57, lists Christopher Lovett as buying land there 4 August 1837! Another is that the Melvins (see the family history on this website) came from County Down, not County Cork, to Pennsylvania, and the father of Ann was John--not Agusta--and he died broke, willing Ann anything he might inherit from his siblings in Pennsylvania!

JENNINGS COUNTY COURT RECORDS for 1818-1850, Probate Order Book 4, page 245, carried Christopher's naturalization. Mary Hariden and William E. Wagner testified in his behalf, and be became a citizen 12 November 1845. In 1880, he was in Cicero Township, Tipton County, Indiana. He died in North Vernon, Jennings County, Indiana, 22 August 1884.
